I agree that such a ruling (if the leak is genuine) would be the correct one; it was never the FedGov's place to stick its nose into such things. The downside is that it will be be very unpopular with the majority of today's electorate, and will energize the Democratic base like almost nothing else could.

Essentially we have two countries, one rural and conservative, the other urban and liberal - and you can see this in "blue" states such as California and New York, as well as "red" states - in fact there is a movement for rural counties in California, Oregon, and Washington to split apart from those states and form a new state, much as West Virginia split off from Virginia in the early 1860s...

To surmise a 98-page long opinion of that sort would be a miracle of telepathy, if not sheer memory - disembodied, of course. And, of course, I find the opinion itself to be the most fascinating part of this - who leaked and why is but a minor part. The opinion gives good insight as to the thinking and guiding philosophy of the Court.

But are you sure it is accurate? Are you sure it is legitimate? Are you confident certain elements of the "opinion" have not been edited? Do you think it was leaked in order for the crazies to get a head start on demonstrating, as a distraction for the benefit of the Biden administration? I see nothing surprising in this (we knew it was coming) except the timing. And I hope someone goes to prison for this leak.

First four questions, no, the analysis of history, case and statutory law, and legal analysis could have been written by a law professor at a really good school, it's a well-written opinion - and it creates precedent which could be broadly applied, even though the Court purports - or attempts - to limit its scope to abortion laws. It's a potentially strong limitation on the powers which the federal government has arrogated to itself since 1913.

As for the leaking, it's not classified - or at least bears no markings to indicate that - so it might not be a criminal offense to leak it. As to motive, that's a matter of speculation, certainly it will cause uproar amongst those who advocate expanding federal power at the expense of the States. If, say, a party were to capture both legislative and executive branches, and outlaw abortion entirely, it would be a similar invasion of the power of the states and their citizens to determine their laws by the democratic process. The ruling reinforces Constitutional Federalism, and that has needed to happen for quite some time now.

agree completely... the more decentralized the government, the better.

a friend who helped me with some projects mentioned to me that his daughter was pregnant and hadn’t decided what to do with abortion and adoption as options she was considering.

i told him that i had been watching a program ‘Long Lost Family’ about adoptees searching for their birth families and in the vast majority of the cases the birth mother had significant regret over her decision. he told me thanks for telling him that.

my friend and his wife adopted the baby and i get Christmas cards every year of the entire family... watching the happy child grow up.
